Sharp Capital Consulting, LLC (SCC) celebrates its fifth year in business in 2010, and our business continues to grow thanks to our
great clients!
SCC completes the design of nonqualified, deferred compensation and restricted stock plans for key employees of an international
company headquartered in the San Francisco Bay area.
SCC works closely with the Board of Directors and finishes a Top Hat plan for the CEO of a large regional construction firm in
Sacramento.
IRS Section 409A regulations were signed into law in 2008. These regulations had been in the works for a couple of years prior to that.
Many compensation and other plan types can be affected by these regulations, such as nonqualified deferred compensation, stock
option, restricted stock, stock appreciation rights, and stock bonus plans. Even certain employment agreements can be affected. Plans
that were out of compliance with these new regulations should have been modified by December 2008 to avoid potential penalties for
plan participants. After 2008, out-of-compliance plans that are continued may subject the participants to penalties and back taxes plus
interest. If you are unsure whether your plans meet these IRS regulations, it is prudent to have the plans reviewed by an expert and
